DMCA Policy

Shapiful ("we," "our," or "us") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), it is our policy to respond to clear notices of alleged copyright infringement.

Reporting Copyright Infringement

If you believe that content available through our service infringes your copyright, you may submit a written notification to our designated Copyright Agent. To be effective, the notification must include the following:

  1. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material (or the subject of infringing activity) to be removed or disabled, along with information reasonably sufficient to allow us to locate the material.
  3. Your contact information, including your full name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature.

Counter-Notification

If you believe that material you submitted was removed or disabled in error or due to misidentification, you may file a counter-notification. The counter-notification must include:

  1. Identification of the material that has been removed or disabled, and the location where it appeared before removal.
  2. Your name, mailing address, telephone number, and email address.
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, that you consent to jurisdiction in any judicial district in which Shapiful may be found, and that you will accept service of process from the person who submitted the original DMCA notification or their agent.
  5. Your physical or electronic signature.

Repeat Infringers

In accordance with the DMCA and applicable law, Shapiful has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We also reserve the right to limit or terminate service access for any user who infringes the intellectual property rights of others, regardless of repeat infringement.

We may update or modify this DMCA Policy from time to time. Any changes will be posted on this page with an updated effective date.
